New I-9 Form

Do the U.S. Citizenship and Immigration Services (USCIS) has issued a new I-9 form, with a revision date of August 7, 2009.  The new form will be valid until August 31, 2012.  The form can be: http://www.uscis.gov/files/form/i-9.pdf

There are no substantive changes in the new form so the old form, with a revision date of February 2, 2009, is still acceptable.  However, that form is likely to be eliminated at some point, so it’s probably wise to start using the new form now.

I-9 Form: Maybe I Will, Maybe I Won’t

Apparently there is much ado about I-9 Forms.   You probably know or read here that new I-9 Forms were to be used effective February 2, 2009.    Well forget about it.   The Department of Homeland Security (DHS) announced on January 30 that it’s postponing the effective date of the new form until at least April 3, 2009.  DHS has also extended the comment period on the new form.   So, if you have burning comments, fell free to comment away.   Given the state of the world is it really necessary to allow time for more I-9 comments?   This action seems to be the result of the Obama administration desire to review regulations issued in the late days of the Bush term.

Until the new form becomes effective (for real?) the DHS would like us to continue to use the old form (“Form I-9 (Rev. 06/05/07) N” with an expiration date of June 30, 2009.

New I-9 Coming

Employers will have to use a new I-9 Form beginning on February 2, 2009. The new Form includes changes to the types of documents that may be accepted to demonstrate identity and employment authorization.  The modifications include: 

All documents must be unexpired. In the past an expired passport was acceptable.

List A documents no longer include Form I-688 Temporary Resident Cards; Form  I-688A Employment Authorization Card; and Form I-688B Employment Authorization Card.

List A will now include certain foreign passports containing machine-readable immigrant visas and the new U.S. Passport Card.

The new I-9 Form is scheduled to be available on the USCIS website on February 2.   Go to:  www.uscis.gov .
